<h1><span style="font-size: large;">Getting out of jail fast in Los Angeles means you post a bail bond.</span></h1>
<p>Bail is set by the court to guarantee you&#8217;ll in court on the date when ordered to do so. When you appear in court, the court then refunds the bail. But if you don&#8217;t appear, the court will keep the bail&#8230;  and a warrant for the defendant&#8217;s arrest is issued. It is really that simple.<br />

How a Bail Amount Is Set</strong></p>
<p>Judges usually set the bail. But, many people want to get out of jail immediately (instead of waiting for a judge).  California jails have standard bail schedules that set the bail amounts for common crimes. An arrested person can get out of jail quickly by paying the amount set out in the bail schedule.<span id="more-513"></span></p>
<p><strong>The Eighth Amendment to the U. S. Constitution requires that bail not be excessive.</strong></p>
<p>This amendment came about to make sure that bail would not be used to raise money for the government or to punish a person for <strong>being suspected</strong> of committing a crime. In keeping with the spirit of bail, it allows the arrested person to remain<strong> free until convicted of a crime</strong>, and the amount of bail must be no more than is reasonably necessary to ensure the suspect appears in court for judgment.</p>
<p>Despite the rules, there are judges who set an impossibly high bail in particular types of cases to keep a suspect in jail until the trial is over. Although bail set for this purpose seems to violate the Constitution, courts have rejected this argument.</p>
<p>The good news is that California allows bail bonds, which lessen the actual cash outlay for bail, in most cases only costing around 10% of the bail.</p>
<p><strong>Bail can be paid in the following way:</strong></p>
<p>* cash or check for the full amount of the bail<br />
* putting up property worth the full amount of the bail<br />
* a bail bond (that is, a guaranteed payment of the full bail amount), or<br />
* a waiver of payment on the condition that the defendant appear in court at the required time (commonly called &#8220;<strong>release on one&#8217;s own recognizance</strong>&#8220;).</p>
<p>A bail bond is like a check held in reserve: It represents the arrested person&#8217;s promise that he or she will appear in court when required. The bail bond is purchased by payment of a nonrefundable premium (usually about 10% of the face amount of the bond).</p>

<p>Today, the Supreme Court ruled:  &#8220;A  suspect who has received and understood the Miranda warnings &#8211; and  has  not invoked his Miranda rights &#8211; waives the right to remain silent by   making an uncoerced statement to the police,&#8221; Justice Kennedy said. He was   joined by Chief Justice John G. Roberts Jr. and Justices Antonin Scalia,   Clarence Thomas and Samuel A. Alito Jr.</p>
<p>Justices John Paul Stevens, Ruth Bader Ginsburg, Sonia Sotomayor and Stephen G. Breyer dissented.</p>
<p>Justice Sonia Sotomayor said the ruling   &#8220;marks a substantial retreat from the protections against compelled   self-incrimination that Miranda v. Arizona has long provided.&#8221; She said   the conviction should be overturned because the prosecution had not   &#8220;carried its burden to show that he waived his right to remain silent.&#8221;</p>
<p>The majority ruling is in line with the position taken by the Obama   administration and Supreme Court nominee U.S. Solicitor General Elena   Kagan. In December, she filed a brief on the side of Michigan   prosecutors and argued that &#8220;<strong>the government need not prove that a   suspect expressly waived his rights</strong>.&#8221;</p>
<p>She said that &#8220;if a suspect knows and understands his Miranda  rights,&#8221;  anything he says can be used against him in court.</p>
<p><strong>What this means is that if you are arrested, you must invoke your rights immediately and ask to see a lawyer. </strong></p>
<p>Failing to do so can result in evidence being used against you, even if it&#8217;s only one word, as in this case&#8230;<span id="more-621"></span></p>

<h3>Supreme Court backs off strict enforcement of Miranda rights</h3>
<p style="padding-left: 30px;">Once the suspect has been informed of his rights, he has the duty to  invoke them, justices say. <strong>The decision reinstates a murder conviction  based mostly on a suspect&#8217;s one-word answer to police.</strong></p>
<p style="padding-left: 30px;">The Supreme Court retreated from strict enforcement of the  famous Miranda decision on Tuesday, ruling that a crime suspect&#8217;s words  could be used against him if he failed to clearly invoke his rights  clearly and, instead, answered a single question after nearly three  hours of interrogation.</p>
<p style="padding-left: 30px;">In the past, the court has said the &#8220;burden rests on the government&#8221; to  show that a crime suspect has &#8220;knowingly and intelligently waived&#8221; his  rights.</p>
<p style="padding-left: 30px;">But in a 5-4 decision Tuesday, the court said the suspect had the duty  to invoke his rights. If he failed to do so, his later words can be used  to convict him, the justices said.</p>
<p style="padding-left: 30px;">Justice Anthony M. Kennedy wrote that police were &#8220;not required to  obtain a waiver&#8221; of the suspect&#8217;s &#8220;right to remain silent before  interrogating him.&#8221;</p>
<p style="padding-left: 30px;">In this case, Michigan police had informed the suspect, Van Thompkins,  of his rights, including the right to remain silent. Thompkins said he  understood, but he did not tell the officer he wanted to stop the  questioning or speak to a lawyer.</p>
<p style="padding-left: 30px;">But he sat in a chair and said nothing for about two hours and 45  minutes. At that point, the officer asked, &#8220;Do you pray to God to  forgive you for shooting that boy down?&#8221;</p>
<p style="padding-left: 30px;">&#8220;Yes,&#8221; Thompson said and looked away. He refused to sign a confession or  speak further, but he was convicted of first-degree murder, based  largely on his one-word reply.</p>

<h1><span style="font-size: x-large;">The California Senate passed a bill that holds parents responsible if their children regularly skipped  school. </span></h1>
<p>The measure would let prosecutors charge parents with  misdemeanors punishable by up to a year in jail and a $2,000 fine if  their children  were chronically truant.  The measure passed the Senate  on a 21-to-9 vote and now goes to the Assembly.</p>
<p>The state of California would hold parents responsible if their  children are chronically truant under a bill the state Senate approved  Thursday.<span id="more-551"></span></p>
<p><img class="alignright size-full wp-image-565" title="california-law" src="http://www.fastoutbail.com/wp-content/uploads/2010/05/california-law.png" alt="California Truancy" width="387" height="354" />The bill would let prosecutors charge parents with <strong> misdemeanors punishable by up to a year in jail and a $2,000 fine</strong> if  their kids miss too much school. Judges could delay the punishment to  parents as an incentive to get their children to class.</p>
<p>It applies  only to parents or guardians of children age 6 or older in kindergarten  through eighth grade. <strong>Prosecutors would have to prove the parents  failed to reasonably supervise and encourage the student to attend  school.</strong></p>
<p>Chronic truancy would be defined in a separate pending  bill as missing 10 percent or more of the school year without a valid  excuse.</p>
<p>Sen. Mark Leno, D-San Francisco, said his bill, SB1317, is  a public safety measure because children who do poorly in school or  drop out are more likely to commit crimes.</p>

<p style="padding-left: 30px;">A report released today by the American Civil Liberties Union shows that  overcrowding and unsanitary conditions that have plagued Los Angeles  County&#8217;s Men&#8217;s Central Jail for more than 30 years still persist, <strong>along  with an apparent culture of violence and fear, including  prisoner-on-prisoner assaults and the use of excessive force by  deputies. </strong></p>
<p style="padding-left: 30px;">The picture of the jail that emerges in stark and disturbing detail in  the report suggests that <strong>prisoners with mental illnesses suffer some of  the worst treatment</strong>, and that retaliation by deputies against prisoners  who complain about conditions as well as a lack of transparency in  conducting investigations into prisoner complaints make it difficult to  assess the full extent of violence that occurs there.</p>
<p style="padding-left: 30px;">&#8220;Men&#8217;s Central Jail is a modern-day medieval dungeon, a dank, windowless  place where prisoners live in fear of retaliation, and abuse apparently  goes unchecked,&#8221; said Peter Eliasberg, managing attorney at the ACLU of  Southern California. &#8220;The jail is not an appropriate facility for  housing prisoners with mental illness, many of whom do not receive  proper treatment. At the root of the many problems plaguing this toxic  facility is overcrowding, and the only solutions are to either reduce  its population dramatically or close it.&#8221;</p>
<p style="padding-left: 30px;">With approximately 20,000 detainees, <strong>the Los Angeles County jail system  is the largest and most expensive in the nation</strong>, costing nearly $1  billion a year to operate. Men&#8217;s Central Jail is nearly 50 years old and  currently houses an average of 5,000 detainees daily. More than half  are simply awaiting trial – in other words, they are presumed innocent  and have yet to get their day in court.</p>
<p style="padding-left: 30px;">As a result of decades-long litigation in which the ACLU charges the  conditions in the jail violate the constitutional rights of detainees,  the ACLU of Southern California and the ACLU National Prison Project are  the court-appointed monitors of conditions within the jail. <span id="more-576"></span></p>
<p style="padding-left: 30px;"><img class="alignright size-full wp-image-577" style="margin-left: 11px; margin-right: 11px;" title="aclu-20100415-453" src="http://www.fastoutbail.com/wp-content/uploads/2010/05/aclu-20100415-453.jpg" alt="LA Jails - ACLU report" width="313" height="352" />The new report, based on the observations of ACLU jail monitors,  numerous interviews with prisoners and thousands of prisoner complaints  gathered between 2008 and 2009, focuses on conditions inside Men&#8217;s  Central Jail, the largest jail in the county&#8217;s system.</p>
<p style="padding-left: 30px;">In one case, a prisoner said he was brutally beaten by deputies after  complaining to an ACLU jail monitor that he and other prisoners on his  jail row had not been allowed to shower for weeks. The deputies broke  his leg and hurt his knee so badly that he had to have surgery. The  ferocious attack had a chilling effect, silencing many of the prisoners  on that row. When a jail monitor visited a few days after the beating,  many refused to talk, while those who did spoke in hushed tones for fear  of also being targeted.</p>
<p style="padding-left: 30px;">Another significant concern is that a high percentage of prisoners are  mentally ill, many of whom are unable to control their disturbed  behavior. A national expert found abuse of prisoners by deputies to be  disproportionately directed toward those with mental illness.</p>
<p style="padding-left: 30px;"><strong>&#8220;The dangerously overcrowded conditions at Men&#8217;s Central Jail exacerbate  violence, filth and mental illness among the detainee population,  creating a poisonous brew,&#8221;</strong> said Mary Tiedeman, jails project  coordinator for the ACLU of Southern California and co-author of the  report. &#8220;No human being should be forced to live in such egregious  conditions. But what is so troubling is that most of these prisoners are  awaiting trial, still presumed innocent.&#8221;</p>
<p style="padding-left: 30px;">It is difficult for the ACLU to assess accurately the extent of violence  inside the jails or to confirm some allegations. The Los Angeles County  Sheriff&#8217;s Department refuses to release basic information about how it  conducts investigations of abuse and metes out punishment. This lack of  transparency raises serious questions about the department&#8217;s  independence and internal review process and could even encourage  violence within the facility. The ACLU is further hampered by a  widespread fear of retaliation among prisoners, portrayed in numerous  prisoner complaints.</p>
<p style="padding-left: 30px;">&#8220;It&#8217;s time for the county and the Sheriff&#8217;s Department to deal with the  longstanding problems, and spending more money on a newer and bigger  jail is not the answer,&#8221; said Margaret Winter, Associate Director of the  ACLU National Prison Project. &#8220;It&#8217;s time for county officials to lower  the jail population by using proven diversion programs such as  electronic monitoring and drug and mental health treatment. <strong>The  conditions at Men&#8217;s Central Jail are simply among the most barbaric of  any jail or prison in the nation.&#8221;</strong></p>

<h3>Garden Grove reported an 11% drop, Anaheim had a 10%  decrease and L.A. saw a 10% drop over the year before, FBI data show.  But in Fullerton, violent crime increased.</h3>
<p><a href="http://www.latimes.com/news/local/crime/la-me-crimes-20100525,0,3044503.story" target="_blank">Los Angeles Times:</a> The number of violent crimes reported in cities across Southern  California dropped in 2009 from the previous year, according to  preliminary figures released Monday by the FBI.</p>
<p>The statistics  show that violent crime nationwide fell 5.5% last year, compared with  figures reported the previous year. But the decrease was even bigger in  areas of Orange County and the Inland Empire, where some cities reported  double-digit drops in the number of murders, robberies, forcible rapes  and aggravated assaults.</p>
<p>The crime drops came as the nation was reeling from rising  unemployment and a bad economy, factors that are commonly believed to  help fuel violence.</p>
<p>&#8220;I just think it shows how little sociologists  know about crime,&#8221; said Malcolm Klein, a USC professor emeritus who has  researched gang violence and crime trends. &#8220;Whatever drives crime is  crime itself rather than how we respond to it.&#8221;<span id="more-547"></span><a href="http://www.fastoutbail.com/wp-content/uploads/2010/05/bw_gavelbooks.jpg"><img class="alignright size-full wp-image-545" style="margin-left: 11px; margin-right: 11px;" title="bw_gavelbooks" src="http://www.fastoutbail.com/wp-content/uploads/2010/05/bw_gavelbooks.jpg" alt="California Crime rates" width="243" height="162" /></a></p>
<p><strong>In Orange County,  Garden Grove reported 541 violent crimes last year, compared to 609 in  2008. That was an 11% drop,</strong> according to FBI figures.</p>
<p><strong>Anaheim,  meanwhile, logged 1,184 violent crimes in 2009 — 128 fewer than the year  before. </strong>That was about a 10% decrease.</p>
<p><strong>The Los Angeles Police  Department had already reported this year that the city had seen a 10%  drop in violent crimes in 2009</strong> compared to the previous year.</p>
<p>However,  not all jurisdictions recorded decreases in violent crimes, the FBI  statistics show.</p>
<p><strong>In Fullerton, the number of violent crimes rose  28% </strong>— from 410 in 2008 to 526 last year. The increase was driven, in  part, by a rise in the reported number of aggravated assaults — 227 in  2008 compared to 291 last year, according to the data.</p>
<p>&#8220;We do have  a lot of assaults in town because we have a lot of bars,&#8221; said Sgt.  Andrew Goodrich, a Fullerton Police Department spokesman.</p>
<p>During  the last several years, Goodrich said, the city&#8217;s violent crime rate has  been relatively stable, which indicates that the 2009 figures may be an  anomaly. &#8220;It definitely appears to be a blip,&#8221; he said.</p>
<p><strong>Ventura  recorded a 7% drop in violent crimes</strong> last year compared to the year  before. During the same period, <strong>Riverside showed a 20% decrease</strong> and  <strong>Ontario reported a 17% drop</strong>, according to the data.</p>

<p>&#8220;Non-serious, non-violent people that normally would have been   sentenced to state prison terms of 36 months or less would go to the   County Jail rather than prison,&#8221; says Tuolumne CAO Craig Pedro. &#8220;That in   turn is going to put people that normally would go to County Jail out   on our streets.&#8221;</p>
<p>&#8220;At least to the Governor&#8217;s credit, he&#8217;s recognizing that this would   be unfair and would pay the county on a per inmate basis,&#8221; adds Pedro.</p>
<p><strong>Counties would receive $11,500 per prisoner</strong> to cover probation   programming, services and alternate custody options.</p>
<p>Part of Governor Schwarzenegger&#8217;s proposal to close the roughly   $20 billion budget shortfall involves reviving a plan to house 15,000 nonviolent  felons in county jails instead of state prisons. This cost-cutting move  would result in some inmates leaving jail early.</p>
<p>Local law enforcement agencies vigorously opposed a similar idea that  Schwarzenegger floated in January, in part because the state would not  have reimbursed counties for housing inmates. That proposal would have  saved the state $291.6 million.</p>

<p><strong>&#8220;It still  puts a burden on local governments, but it&#8217;s better than getting inmates  without the money,&#8221; </strong>Sacramento County Sheriff John McGinness said.<span id="more-537"></span></p>

<p>It is unclear to what extent state  prisoners would displace county inmates. Warner said  32 counties have court-ordered population caps, including most in the  Sacramento region. If the plan calls for state prisoners to serve in  those jails, sheriffs would release lower-level county inmates.</p>
<p>&#8220;If  we&#8217;re replacing one body with one body, how safe is that going to be  for the public?&#8221; said Assemblyman  Curt Hagman, R-Chino Hills, vice chairman of the Assembly Public Safety Committee. &#8220;Are there going to  be protections for counties that are impacted?&#8221;</p>
<p><strong>Warner said  sheriffs are already releasing jail  inmates early because of overcrowding.</strong> In many cases, they require  those inmates to undergo electronic monitoring or drug rehabilitation  once out of jail.</p>
<p><strong>&#8220;This is markedly better than the January  proposal,&#8221;</strong> Warner said, noting that the plan includes additional  new funding for public safety programs. <strong>&#8220;To the governor&#8217;s credit, he  listened to us.&#8221;</strong></p>
<p>Hagman said he wasn&#8217;t supporting the idea but is  willing to discuss ways in which it might work, such as transferring  inmates to counties that have jail space.</p>
<p>Hagman also noted that the proposal could be helpful in avoiding  judicial orders to release state prisoners.</p>
<p>California houses an  inmate population of roughly 150,000 in a system designed for 80,000. A  federal court last year ordered the state to reduce its population to  110,000 within two years.</p>
<p><strong>Schwarzenegger officials have submitted  an inmate reduction plan to the court that relies on sending fewer  people to prison for parole violations and lower-level crimes.</strong> But they  have filed an appeal to the U.S.  Supreme Court that challenges the lower court&#8217;s ability to order  states to release prisoners.</p>

<p>After missing Thursday&#8217;s  scheduled probation hearing because she was <a href="http://www.tmz.com/2010/05/20/lindsay-lohan-cannes-party-photos-bail/">&#8220;stuck&#8221;  in Cannes</a>, she&#8217;s scheduled for a Monday make-up hearing.</p>
<p><a href="http://www.sfgate.com/cgi-bin/blogs/dailydish/detail?blogid=7&amp;entry_id=64040" target="_blank"> A warrant was issued for the star&#8217;s arrest</a> after  she failed to attend a mandatory probation hearing in Los Angeles on  Thursday morning.</p>
<p>She was due before Judge Marsha Revel at Beverly Hills Courthouse  after only completing 10 of her 13 court-ordered alcohol education  classes, stemming from a 2007 arrest.</p>
<p>But Lohan found herself stranded in Europe on Tuesday after losing  her passport while attending the Cannes Film Festival in France.<span id="more-396"></span></p>

<p>The 23 year old is next expected in court on Monday.</p>
<p>Judge Revel stated at the hearing on Thursday she had reason to  believe Lohan had violated the terms of her probation &#8211; which could  result in a 180-day prison sentence for the actress.</p>

<p><!-- Module starts: a-body-first-para (ArticleText) -->In  a dramatic escalation of the war against illegal supergraphics in Los  Angeles, authorities have jailed a businessman accused of posting an  eight-story movie advertisement on an office building at one of  Hollywood&#8217;s busiest intersections.</p>
<p>Kayvan Setareh, 49, of Pacific  Palisades was arrested at his home Friday night and ordered held on  $1-million bail. An arrest warrant obtained by Los Angeles City Atty.  Carmen Trutanich accuses Setareh of three misdemeanor city code  violations, two of them related to the city sign law, according to  William Carter, Trutanich&#8217;s chief deputy.</p>
<p><strong>The arrest was an unusually aggressive move</strong> by Trutanich and comes  less than a week after the city attorney filed a separate lawsuit  involving more than a dozen other supergraphics scattered across the  city. Just days after that lawsuit was filed, workers used bolts and  wire to wrap the new ad around the face of a 1928 office building on the  northeast corner of Hollywood Boulevard and Highland Avenue, a major  tourist destination along Hollywood&#8217;s Walk of Fame. Trutanich&#8217;s office  said Setareh had an &#8220;ownership interest&#8221; in the building.</p>
<p>&#8220;The  days of lax and inconsistent enforcement of billboard and outdoor  advertising laws in this city are over,&#8221; Trutanich said in a prepared  statement.</p>
<p>Setareh, who is scheduled to be arraigned Monday,  could not be reached for comment Saturday. A woman who answered a phone  listed in Setareh&#8217;s name declined to discuss the case but said the  arrest had been &#8220;a shock to the whole family.&#8221;</p>
<p>City officials say  that unpermitted supergraphics pose a threat to public safety because  the huge sheets of vinyl can fall onto cars and pedestrians if they are  not attached properly. Still, some law enforcement observers voiced  surprise at the large bail amount, saying $1 million is typically used  in far more serious cases, such as homicide, rape and kidnapping.</p>
<p>&#8220;I&#8217;m not saying don&#8217;t hold him accountable,&#8221; said Nick Pacheco, a  former prosecutor and city councilman who is not affiliated with the  case. &#8220;But I don&#8217;t see the relationship between a million-dollar bail  and three misdemeanors.&#8221;</p>
<p>City officials suspect that the  unpermitted image &#8212; an advertisement for the film &#8220;How to Train Your  Dragon&#8221; &#8212; was timed to coincide with the 82nd annual Academy Awards  ceremony next week, which is staged at the Kodak Theatre down the  street.</p>
